These Terms and Conditions ("Terms") govern your use of the Precursor website, app and services (together, the "Services"), provided by Precursor Health Pty Ltd (ABN 16 698 610 749) ("Precursor", "we", "us" or "our"). By creating an account, making a booking or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

About Precursor

Precursor is an Australian preventive health platform. We arrange access to diagnostics and screening services delivered by appropriately qualified third-party providers, facilitate review and guidance from qualified clinicians, and deliver results and information through our platform.

Important health disclaimer

Precursor provides preventive health screening and information services. The Services are not a substitute for medical care from your regular doctor, and information provided through the platform is general in nature and not a diagnosis. Screening may not identify all conditions and may lead to recommendations for further investigation. You should always discuss your results and any health concerns with a qualified health practitioner.

Precursor is not an emergency service. If you require urgent medical attention, call 000 or attend your nearest emergency department.

Eligibility and accounts

To use the Services you must be at least 18 years old and reside in Australia. When you create an account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login details and for all activity under your account. If you believe your account has been accessed without authorisation, contact us as soon as possible.

Bookings and third-party providers

Diagnostics and screening services booked through Precursor are delivered by third-party providers, such as pathology laboratories, imaging clinics and other accredited facilities, and reviewed by qualified clinicians. While we take care in selecting the providers in our network, each provider remains responsible for the services they deliver. Availability of specific services may vary by location and provider.

Clinicians involved in your care exercise their own independent professional judgement. In some cases, a clinician may determine that a service you have requested is not appropriate for you, in which case we will discuss alternatives or arrange a refund in accordance with our Refund Policy.

Fees and payment

Fees for our services are displayed at the time of purchase and are in Australian dollars, inclusive of GST where applicable. Payment is processed through secure third-party payment providers. For memberships and subscription services, fees are billed in advance for the applicable period and continue until cancelled. We may change our fees from time to time, and any changes will apply from your next billing period, with reasonable notice.

Cancellations and refunds

Cancellations, rescheduling and refunds are handled in accordance with our Refund Policy, and nothing in these Terms limits your rights under the Australian Consumer Law.

Acceptable use

You agree not to use the Services in any way that is unlawful, that interferes with the operation of the platform, that attempts to gain unauthorised access to our systems or another person's information, or that misrepresents your identity or health information. We may suspend or close accounts that breach these Terms.

Intellectual property

All content on the Precursor website, app and platform, including text, design, graphics, logos and software, is owned by or licensed to Precursor and is protected by intellectual property laws. You may use the platform and its content for your personal, non-commercial use, but you may not otherwise reproduce, distribute or create derivative works from it without our written permission. Your health information remains yours, and our handling of it is governed by our Privacy Policy.

Consumer guarantees and liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under law that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, and other than as required by the consumer guarantees, we exclude liability for indirect or consequential loss arising from your use of the Services, and our total liability in connection with the Services is limited to resupplying the relevant service or refunding the amount you paid for it, at our election.

Changes to the Services and these Terms

We are continuing to develop and improve the Services, and features may change over time. We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by email or a notice on the platform. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms or where required by law. Termination does not affect any rights or obligations that arose before it.

Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
